We are currently seeking an effective Commercial Manager to join our commercial team. The primary purpose is to deliver best practice contract management as an integral part of the business to support GTS win new business and sign commercially robust contracts in the pre-contract phase and ensure that obligations are met, contractual risk is appropriately managed and opportunities are maximised through constructive contractual relationships throughout the life of the contract.
As the Commercial Manager you will take direct responsibility for commercial matters on a range of designated Project/s through the delivery and support phases of both current and future projects. The role is central to the commercial success of the business. As such the Commercial Manager will be a proactive and integral member of the GTS team to ensure that the commercial objects of the business are achieved and initiatives for commercial procedures are recommended / implemented and adhered too.
Primary purpose of the role
The Commercial Manager will provide advice and recommendations to the projects under their remit and as directed by the Senior Commercial Manager on commercial issues, risks, liabilities and opportunities.
Provide guidance on terms and conditions for the benefit of the broader project team and maintain awareness of best commercial practice.
Provide support to senior management and where required participate in commercial negotiations with customer, consortium partners and in conjunction with Procurement, sub-contractors and other 3rd parties.
Respond to and negotiate customers proposed contractual agreements such as Deeds of Variation and Contract ‘Changes’ and support senior management in the management of such changes, including the preparation, approval and negotiation. Identify and manage issues and disputes arising with customers in conjunction with the Legal function.
Skills & experience
Demonstrable experience of customer negotiation, assisting in the formulation and implementation of negotiation strategy
Ability to proactively manage claims to try and prevent disputes.
Change Management, Ensuring all programmes / projects have a defined change control process
Proven experience in the mitigation of contractual risk, with the ability to manage and mitigate unnecessary business risk
Experience within a Commercial role, specifically in the Rail or services industry.
